On motion of Trustee Iadevaio, seconded by Trustee Cummings and carried unanimously, the Board approved the minutes from the October 1, 2013 Committee Meeting and the October 8, 2013 Business Meeting.

New Business

1.              Annual Fire Inspection Review

The Fire Inspector will be present to discuss the Annual Fire Safety Report which the Superintendent of Schools recommends the Board of Education accept.

Bruce Bingham, the Fire Inspector, addressed the Board of Education and community regarding the recent fire inspection.  He stated that it was the first time he had ever given a school district a perfect score.  Mr. Bingham commended the District from the "top on down" for their excellent job.

2.              Affordable Care Act Compliance & Implementation - Adoption of 4980H Measurement & Stability Periods

WHEREAS, on March 23, 2010, the Patient Protection and Affordable Care Act (“ACA”) was enacted into federal law;

WHEREAS, on March 30, 2010 the Health Care and Education Reconciliation Act of 2010, amending the ACA, was enacted into federal law;

WHEREAS, the ACA added a new Section 4980H to the Internal Revenue Code requiring employers with more than fifty (50) full-time employees to offer affordable minimum essential coverage which provides minimum value, as those terms are defined within the ACA and its implementing regulations, to its full-time employees, as that term is defined within the ACA and its implementing regulations, or pay a penalty tax;

WHEREAS, due to an implementation delay announced in July 2013, Section 4980H is currently scheduled to become effective beginning January 1, 2015;

WHEREAS, on January 2, 2013, the Internal Revenue Service and the U.S. Treasury proposed new federal regulations further outlining covered employers’ obligations under the new Section 4980H of the Internal Revenue Code;

WHEREAS, Section 4980H-3 of the proposed regulations (26 C.F.R. § 4980H-3) outlines safe harbor methods for determining employees’ hours of service and full-time status for purposes of the ACA, including a look-back measurement method for determining whether an employee is a full-time employee covered under Section 4980H; and

WHEREAS, pursuant to Section 4980H-3 of the proposed regulations, in order to avail itself of the look-back measurement method, an employer must select the standard measurement periods and corresponding stability periods the employer will use;

NOW, THEREFORE, BE IT RESOLVED, that the Board of Education, upon the recommendation of the Superintendent of Schools, hereby designates the following standard measurement period(s) and corresponding stability period(s) for the following categories of District employees:

Tricia Lucas, from D'Arcangelo & Co., addressed the Board of Education to state that the District had received the highest level of opinion during the recent audit.

Information and Exploration

1.              School Board Recognition Week Presentations

Dr. Heidenreich began the presentation for School Board Recognition by acknowledging how Board Members are volunteers and the High School Board member is unique in that they serve on two Boards - their elementary district and the high school district.  They dedicate many hours of their time to serving on the Board of Education.

 

Students from each of the District's buildings presented the Board of Education with gifts of artwork that will be displayed in the Board Room in the District Office.

 

School Board President Antonelli thanked the Principals and students for the gifts and stated that the students are why the Board Members do what they do.

Attorney's Report

John Sheahan, Attorney for the District presented a report regarding a recent decision in which the Appellate Division for the First Department reviewed a challenge by a non-custodial parent to a school district policy that deferred to the educational decisions of the parent with primary custodial custody for parents whose parents are divorced with joint custody.   A copy of the report was given to the District Clerk for distribution to the Board of Education.

C.              Award of Graduation Facilities Use Contract

Be it resolved that upon the recommendation of the Superintendent of Schools, that the Board of Education hereby awards a nonexclusive contract to Long Island University, C.W. Post Campus, 700 Northern Boulevard, Greenvale, New York, 11548 for use of facilities and premises for the graduation ceremony of Valley Stream Central High School, on Wednesday, June 25, 2014, at a fee of $9,727.00, and hereby authorizes the Board President to execute said agreement.

Bids were advertised, in compliance with General Municipal Law 103, in the official newspaper of the district on Monday, May 6, 2013, and bid packages were mailed to 9 separate vendors.  Sealed bids were received from 1 vendor in the Administrative Offices of the Board of Education, One Kent Road, until 11:00 AM on Wednesday, May 22, 2013 at which time it was opened and read aloud.  The Business Committee recommends that we reject all bids, as sole bidder only bid on 5% of the items. (Bid #13/14-09)

Old and New Business

Board Vice President Frank Chiachiere shared that he had the privilege to attend the annual New York State School Boards Association annual conference in Rochester, New York.  It is a great opportunity for staff development for Board members.  He also had the opportunity to see Trustee Iadevaio receive the Dyer Award, the highest award a Board member can receive in New York State.

Motion to Enter into Executive Session

At 9:06 p.m., on motion of Trustee Trogel, seconded by Trustee Cummings and carried unanimously, the Board entered into Executive Session, with the Board only, to discuss the employment history of a particular person, discussion regarding proposed, pending and current litigation and for collective negotiations pursuant to Article 14 of the Civil Service Law (the Taylor Law).  No action was anticipated.

Motion to Reconvene into Public Session

On motion of Trustee Trogel, seconded by Trustee Cummings, and carried unanimously, the Board came out of Executive Session at 9:50 p.m.
